By accepting the terms and conditions detailed below, you are granted access to the Gemstones and Jewellery Community Platform (the Platform), membership account hosted under the URLhttps://community.gemstones-and-jewellery.com. Membership grants you access to a variety of resources and tools developed on behalf of the Coloured Gemstone Working Group (CGWG) by TDI Sustainability, a company registered in the United Kingdom, with headquarters located at Delta Place, 27 Bath Road, Cheltenham, Gloucestershire, GL53 7TH and Company Registration Number 08825320.

While all account data and results generated on the Platform will be kept confidential, TDI Sustainability reserves the right to analyse platform activity and publish anonymised results data for statistical purposes. All factual information presented and underlying tools hosted on this platform are accurate to the best of TDI Sustainability’s knowledge.

1. Your Responsibilities

1.1 You must provide true, current, accurate and complete information about your organisation to each question or data entry point during the registration process or tool use. It is your responsibility to keep this and related organisational details and data current, accurate and complete when your organisation details change. TDI Sustainability exercises no control whatsoever over the content of the information provided.

1.2 You are responsible for all acts or omissions of your organisation’s employees or agents or any other party using your organisation’s account, including the content of communications and data transmissions through the Platform.

1.3 You (including employees, agents or any other user authorised to use your account) will not publish, distribute or disseminate defamatory or otherwise unlawful material through the use of the service.

1.4 You will not use the Platform to threaten, harass, stalk, abuse, or otherwise violate the legal rights (including rights of privacy) of others.

1.5 You will not charge third parties for use of the Platform and you agree to credit TDI Sustainability and the CGWG in case of public communication about the platform.

1.6 You will not use the Platform to infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy.

1.7 Failure to observe any of the foregoing limitations may result in civil or criminal liability, and/or the immediate termination of your access to the Platform at our option.

2. Your Responsible Usage

2.1 You acknowledge that TDI Sustainability may take all reasonably necessary steps to ensure the efficient operation of the Platform.

2.2 You must comply with rules, regulations and acceptable usage policies. If you act recklessly or irresponsibly or endanger the network or systems, your access to the Platform may be suspended or terminated at any time.

2.3 You will be notified, at our option, prior to suspension or termination of your access to the Platform.

2.4 You take full responsibility for maintaining the security of your account. Unauthorised usage of your account by a third party will result in you being responsible for any damages or charges incurred and termination of your access to the Platform at our option.

2.5 Storage, transmission or distribution of any material in violation of federal or state legislation is prohibited. This includes copyright material, material reasonably judged as threatening or obscene, or material protected by trade secrets.

2.6 You must not use, or allow any other person to use, the network and systems for any activities of an illegal or fraudulent nature, including any activities prohibited under local, national and international law.

2.7 The use of all learning and capacity building resources and tools is granted for educational and other non-commercial purposes only.

3. Service Levels

3.1 Our goal is to provide a fault-free service although we cannot guarantee this. We will endeavour to conduct all scheduled maintenance outside of regular business hours.

However, we may be required to suspend supply of the service during business hours in order to carry out emergency repairs on our systems.

3.2 You may report service faults by email to

support@gemstones-and-jewellery.com.

3.3 The support team will use reasonable efforts to identify and resolve the fault.

3.4 If the issue cannot be resolved by the support team, the procedure to escalate the ticket to a technical expert for further investigation will be implemented.

3.5 When an issue has been resolved or closed you will receive an email notifying you.

4. Data Use and Access

4.1 We do not use your data (data entered by you that identifies you or your organisation) in order to generate revenue other than through provision and delivery of the service provided by operation of the Platform.

4.2 We do not provide access to your data to third parties other than law enforcement agencies as required for the lawful operation of the system.

4.3 We will use information, including the data described above, you enter into the Platform in the following ways:

(a) to provide access to and use of the services and its network

(b) carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us;

c) to notify you about changes to our service

d) to ensure that content from our site is presented in the most effective manner for you and for your computer

4.4 We will also use this information, including the data, in the following ways:

(a) to administer the Platform and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

(b) to improve our site to ensure that content is presented in the most effective manner for you and for your computer;

(c) to allow you to participate in interactive features of our service, when you choose to do so;

(d) as part of our efforts to keep the Platform safe and secure.

5. Data Ownership

5.1 At all times, your organisation’s data remains the property of your organisation. By agreeing to these Terms of Use, you authorise us to use and distribute your data in the course of the proper and efficient operation of the Platform.

5.2 Once you cancel your service, TDI Sustainability will remove your data from view by other users of the platform no later than 90 days from the date of cancellation. Your data shall not be retrievable after this point by TDI Sustainability.

5.3 TDI Sustainability may retain metadata pertaining to your account and usage for an indefinite period.

6. Data Breaches

6.1 If we discover that your data has been lost or compromised, we will notify you as soon as practicable by email and/or telephone, unless that notification would compromise a criminal investigation into the breach.

6.2 When we are in possession of evidence of criminal activity associated with the breach (such as hacker activity) we will notify appropriate law enforcement agencies.

7. Limitation of Liability

Under no circumstances will TDI Sustainability, its subsidiaries, its employees, its licensors or any underlying service provider be liable for any costs or damages arising directly or indirectly from your use or inability to user the Platform including any indirect, incidental or exemplary, multiple, special, punitive or consequential damages. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability or any other basis, even if TDI Sustainability has been advised of the possibility of such damage. In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, TDI Sustainability’s liability in such jurisdictions shall be limited to the extent permitted by law.

9. Indemnity

Upon a request by TDI Sustainability, you agree to defend, indemnify, and hold harmless TDI Sustainability and its subsidiaries and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including legal fees, which arise from your use or misuse of this site.
